Nicholas Smith

Senior Associate

London

Nicholas is a Senior Associate in the London office and has a wide range of experience advising clients in the energy, infrastructure and construction sectors, from the provision of initial advice on claims under contract and throughout the dispute resolution process.

Nicholas has represented contractors and major consultants in disputes concerning a number of complex, high value projects around the world, with particular focus on road, and airport projects. He has experience of construction projects, involving coal power plants, railways, road projects, and defence projects.

Nicholas’ experience comprises acting under a variety of dispute resolution mechanisms including arbitration, courts, adjudication and DABs/DRBs in the UK, the Middle East, and Africa. He also has experience of a variety of ADR procedures including mediation, and expert determination.

His experience includes working on cross-border disputes in relation to construction and infrastructure projects, including:

  • Advising a Japanese contractor in an ICC arbitration in respect of its claims against a state entity concerning the construction of a major road in Tanzania.
  • Advising a world leading consultant in an ICC arbitration in relation to disputes arising from the design and construction of an airport in the UAE.
  • Advising a main contractor in an ad hoc arbitration in respect of its claims against a state entity concerning the construction of a port in Tanzania.
  • Acting for a top 10 UK contractor in relation to claims regarding cladding and compliance.
  • Acting in relation to claims concerning the Athlete’s Village at the Olympic Park in Stratford, London.
  • Commercial legal advice for the redevelopment of Battersea Power Station.

Nicholas has spent time on secondment to a major UK consultant who works internationally assisting with the preparation of contract documents for project in the UK and internationally.

Nicholas trained at Beale & Company and has been with the firm for over 12 years. Nicholas is a member of the Society of Construction Lawyers.
